New Version of Form I-9 is Now Available!

Federal law requires that every employer* who recruits, refers for a fee, or hires an individual for employment in the U.S. must complete Form I-9, Employment Eligibility Verification. Form I-9 will help you verify your employee's identity and employment authorization.

 

On August. 01, 2023, USCIS published the Form I-9 Federal Register notice announcing a new version of Form I-9, Employment Eligibility Verification, that the Office of Management and Budget approved on Oct. 21, 2019. This new version has been both streamlined and shortened than its prior proceeding version.  contains minor changes to the form and its instructions. Employers should begin using this updated form as of August 01, 2023. However, employers may continue to use the older Form I-9 through Oct. 31, 2023.

USCIS made the following changes to the form and its instructions:

  • Now allows the ability for the form can be filled out on tablets and mobile devices. by downloading onto the device and opening in the free Adobe Acrobat Reader app

  • Reduced Sections 1 and 2 to a single-sided sheet. No previous fields were removed. 

  • Moved the Section 1 Preparer/Translator Certification area to a separate page, referred to as (Supplement A) that employers can provide to employees when necessary. Employers may attach additional supplement sheets as needed. 

  • Moved the Section 3 Reverification and Rehire area to a separate, standalone page (Supplement B) that employers can print if or when rehire occurs or reverification is required. Employers may attach additional supplement sheets as necessary.

  • Removed use of "alien authorized to work" in Section 1 and replaced it with "noncitizen authorized to work" as well as clarified the difference between "noncitizen national" and "noncitizen authorized to work."

  • Certain features on the form have been removed to allow the form to be downloaded easily. This also removes the requirement to enter N/A in certain fields.

  • Notice at the top of the form which explains how to avoid discrimination in the Form I-9 process, has been updated.

  • Revised the Lists of Acceptable Documents page to include some acceptable receipts as well as guidance and links to information on automatic extensions of employment authorization documentation.

  • Added a checkbox for E-Verify employers to indicate when they have remotely examined Form I-9 documents.

The new form is scheduled to expire July 31, 2026A revised Spanish version of Form I-9 with an expiration date of 5/31/2027 is also available, but for use in Puerto Rico only.
